Haqdaar privacy notice
Who we are
Haqdaar is an AI agent that files and chases stuck refunds on WhatsApp. For your data, Haqdaar is the "Data Fiduciary": we decide why and how it is used.
Haqdaar is a brand run by Srinal Earakula (not an incorporated company). Data fiduciary: Srinal Earakula, contact grievance@haqdaar.co.in. Postal address: 11-2-424, Hyderabad, Telangana 500061.
Contact: hello@haqdaar.co.in · Website: https://haqdaar.co.in · WhatsApp: +91 91770 26677
What data we collect
Only what's needed for your complaint:
- Contact: your WhatsApp number and the name on your WhatsApp profile, plus your email if you give it.
- Case details: the screenshots and documents you send; amounts, dates, transaction IDs/UTR, PNR or order IDs; the bank, airline or platform involved; any complaint numbers.
- Messages: our chat with you and any replies the company sends about your case.
- Authorisation record: your written YES authorising us to file for you, with its date and time.
- Payment details for our fee, if money is recovered and a fee applies. Fees are paid by UPI only, so we keep the UPI transaction reference.
We never ask for your UPI PIN, OTP, card CVV, net-banking password or Aadhaar number. Please don't send them.
Why we use it
To work out which rule applies to your refund, draft and file the complaint, follow it up and escalate it, keep you updated, and collect our fee if money is recovered. We don't sell your data, use it for advertising, or use it for anything unrelated to your complaint.
Haqdaar itself doesn't use your data to train AI. Your screenshots and chat messages are processed by Google Gemini, the AI model we use to read them and draft complaints. We currently use Gemini's free tier, whose terms may allow Google to use this data to improve its services. We'll update this notice when that changes.
Your consent
We ask before collecting your case details: you reply YES in the chat. Filing for you needs a separate written YES. You can withdraw consent as easily as you gave it, by telling us in the chat or emailing grievance@haqdaar.co.in. After you withdraw, we stop. Anything already filed stays with the company or regulator we sent it to.
Who we share it with
Only those needed for your complaint:
- The bank, airline, merchant or e-commerce platform the complaint is against.
- Where escalation is needed: NPCI, the RBI Complaint Management System (RBI Ombudsman), AirSewa, the National Consumer Helpline or the consumer commission portal.
- Service providers that process data for us: WhatsApp (Meta) for messaging; Kapso, our WhatsApp platform; Resend for email; Railway for hosting; Supabase for our database; Google Gemini, the AI model that reads your messages and drafts complaints. If we add a payment processor, we'll list it here.
- Authorities, if the law requires it.
How long we keep it
We keep case data until your case closes, plus 12 months (for follow-up questions and fee disputes), then delete it. Authorisation and fee records may be kept longer if the law requires it (e.g. tax/accounting). If a case is never filed and you stop replying, we delete it after 90 days.
Deleting your data
- On WhatsApp: reply with exactly: delete my data (as the whole message; "erase my data" or "forget me" also work), or
- Email grievance@haqdaar.co.in.
We'll confirm once it's done. We can't delete copies already held by the bank, airline, platform or regulator; you can ask them directly.
Your rights
You can: ask what data we hold and who we've shared it with; correct, complete or update it; have it erased; withdraw consent; nominate someone to exercise these rights if you die or can't act; and complain to us and then to the Data Protection Board of India.
Grievance officer
Name: Srinal Earakula · Email: grievance@haqdaar.co.in · Address: 11-2-424, Hyderabad, Telangana 500061
We aim to reply quickly, and in any case within 90 days, the maximum under DPDP Rule 14(3).
Complaining to the Data Protection Board
If you're not satisfied with our response, you can complain to the Data Protection Board of India. We'll add a link to the Board's official complaint page here once it's available.
Children
Haqdaar is for adults (18+). We don't knowingly process children's data. If a case involves someone under 18, a parent or guardian must contact us and give verifiable consent. Otherwise, we'll delete the data.
Changes
If we change this notice, we'll update the date here and tell active users on WhatsApp before any change to how we use their data.
This notice explains how we handle your data. It isn't legal advice, and Haqdaar is not a law firm.
